1. Acceptance of terms
By accessing or using VFXLY (the "Service"), operated by Zurcloud Consulting LLC ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
VFXLY is an AI video generation workspace. The Service may allow you to generate, edit, store and export video and related media using various third-party AI models. Features are subject to change as we develop the product.
3. Acceptable use
You agree not to use the Service to generate or distribute content that is illegal, infringing, defamatory, or that violates the rights of others, including privacy and intellectual property rights. You are responsible for the content you generate and for complying with applicable law.
4. Intellectual property
The Service and its software, design and branding are owned by Zurcloud Consulting LLC. To the extent permitted by the applicable provider terms, output generated through the Service is yours and you may use it for personal or commercial purposes, subject to these Terms and the terms of the underlying model providers.
5. Availability & warranty
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free or that results will meet your expectations.
6. Limitation of liability
To the maximum extent permitted by law, Zurcloud Consulting LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Service.
7. Third-party providers
The Service integrates with third-party AI model providers whose own terms, usage limits and content policies apply to the generation of media. We are not responsible for the practices of these providers.
8. Termination
We may suspend or terminate your access to the Service if you violate these Terms or applicable law, or if required to do so.
9. Governing law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
